“I was appointed by a Republican and will retire under a Republican”

This is what Justice Stevens is rumored to have said off the record.

I’ve heard this rumor as well, along with the one that has Stevens stepping down after this term is over. But blogging has taught me that these rumors (even those attested to by “extremely reliable” sources :) ) often don’t pan out; so take this post for what it is worth: sheer speculation.

I will say this though: If Stevens does retire from the Court this summer, get ready for the political battle to end all political battles. Seriously, I do not envy the unmitigated hell that the next Supreme Court nominee will be forced to go through. It will make the process leading up to Alito’s confirmation look like a cakewalk.

But the answer, Mr. President (just in case you slept through the Miers debacle) is NOT to nominate an unknown “moderate” of questionable ability to the high Court (again). No sir, it is time to give the dems and penumbra lovers the bayonet and reverse the course of jurisprudential history by nominating the patron saint of SA. The fight is predetermined, Mr. President, so let’s nominate someone worth fighting over, shall we?

    I whole-heartedly agree. And if the fight is this fall, during the mid-term elections, so much the better.

    Now, does the GOP and President Bush have the backbone necessary? Maybe the President, but I have sincere doubts about the GOP Senate leadership.

    You are right Dutch. That is why I hope the next vacancy doesnt occur until Frist is out and McConnell is maj leader. He will give that pontificating actor–John Warner–the waterboard treatment if he waxes eloquent about the beauty of filibusters. In all honesty, Bush’s ability to nominate a bona fide conservative anytime after Nov 06 will depend on Republican keepingat least 52 or 53 seats in the Senate. (Sorry about the namecalling; too much coffee.)

    Wait, why would there be a fight? I thought Alito was THE critical swing vote, and if confirmed would spiral America back to the dark ages. Are you telling me that was just hyperbole?

    OK, I’ll say it — it would be somewhat awkward if three successive GWB SCOTUS nominees — all of whom will have been chosen vice sitting Protestant Justices, if Stevens is next to leave — were white Catholic men.

    For this reason, a Protestant woman like Karen Williams or Edith Clement strikes me as a more probable pick #3. That was Bush’s first instinct.

    To Plainsman: Joy Clement is a Catholic. Her husband is an Episcopalian. Niether of which whould make a darn bit of difference in choosing judges, of course, in a better world,
